1. Introduction & Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you and North Point Digital Engineering LLC ("we", "us", or "our"), governing your access to and use of the DuoPhase application, website at duophase.app, and all associated services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

2. Important Medical Disclaimer (Not Medical Advice or Contraception)

DuoPhase is an educational cycle-awareness and couple communication support tool. It is not a medical device, clinical diagnostic instrument, healthcare provider, or contraceptive system.

• No medical advice: Any cycle calculations, phase estimates, tips, or AI-generated suggestions are provided strictly for general informational and personal awareness purposes. They are not intended as medical advice, clinical diagnosis, treatment, or prevention of any medical condition.
• Not for contraception: Calendar calculations and phase estimates are rough statistical approximations and must never be relied upon as a method of contraception or family planning. Cycle timing naturally varies.
• Consult a professional: Always seek the advice of a qualified physician or other healthcare professional with any questions regarding personal health, medical symptoms, irregular cycles, or reproductive health. Never disregard professional medical advice because of information in DuoPhase.

3. Account Registration & Security

• Eligibility: You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account and use the Service.
• Account details: You agree to provide accurate and current information when registering. You are responsible for safeguarding your credentials and for all activities occurring under your account.
• Notification: You must notify us immediately at [email protected] if you discover or suspect unauthorized access to your account.

4. Partner Sharing & Voluntary Consent

DuoPhase is built around privacy and individual control. Connecting accounts with a partner does not automatically share your private records:

• Each category of sharing (phase estimate, timing calendar, active needs, energy level, mind check-ins) starts turned off.
• You retain sole discretion to enable, disable, or modify sharing switches at any time.
• Past period logs, cycle days, specific symptoms, and private journal notes are never shared with a connected partner.
• Either partner may disconnect the relationship at any time, which immediately revokes partner access to shared views.

5. In-App Purchases, Subscriptions & Renewals

• Paid features: DuoPhase offers optional paid products (such as the Insight Pack) available as one-time purchases or recurring subscriptions.
• Billing: Purchases made via app store platforms (such as Google Play or Apple App Store) are processed and billed directly by the respective store under their terms and payment policies.
• Automatic renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled through your app store subscription management settings at least 24 hours prior to renewal.
• Refunds: Refund requests for in-app purchases are handled in accordance with the policies of the platform through which the purchase was made (Google Play or Apple App Store).

6. Acceptable Use & Prohibited Conduct

You agree to use the Service in accordance with all applicable laws and respect other users. You agree not to:

• Use the Service for any unlawful, harassing, abusive, coercive, or fraudulent purpose.
• Attempt to access unauthorized accounts, servers, or networks, or circumvent security, authentication, or encryption mechanisms.
• Introduce viruses, malware, trojans, or automated scraping bots that degrade or disrupt service infrastructure.
• Misrepresent your identity or attempt to monitor an individual without their voluntary and informed consent.

7. Intellectual Property

All software, visual designs, brand assets, artwork, trademarks, illustrations, and content provided by DuoPhase are the exclusive intellectual property of North Point Digital Engineering LLC or its licensors. These Terms grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

8. Termination & Account Deletion

You may terminate your account at any time directly in the app or via our Account Deletion page. Upon deletion, your personal account records, tracking history, and private notes are permanently removed from production databases in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms, threaten the safety of others, or engage in abusive behavior.

9. Disclaimers & Limitation of Liability

As-Is Service: The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.

Limitation of liability: To the maximum extent permitted by applicable law, North Point Digital Engineering LLC and its affiliates, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or personal distress arising from your use or inability to use the Service.

10. Governing Law & Contact

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law principles.
